A New York court recently struck down state Office of Mental Health regulations governing research involving subjects with impaired decisionmaking capacity. The court held that neither incapacitated adults nor minors could participate in any research protocol that contained a nontherapeutic element, irrespective of possible benefits to the subject or the importance of the knowledge to be gained. Although the decision rested on a technical point of law and dealt only with psychiatric research, the court's holding has significantly broader implications.

Throughout history there have been people who say it is all illusion. I think they may be right. But if they are right what could this mean? Is there a theory that explains the essence of consciousness? Or is consciousness itself just an illusion? The "last great mystery of science," consciousness was excluded from serious research for most of the last century but is now a rapidly expanding area of study for students of psychology, philosophy, and neuroscience. This volume presents an exploration of the intersection between the work of Michel Foucault and feminist theory, focusing on Foucault's theories of sex/body, identity/subject, and power/politics. Like the other books in this series, this volume seeks to bring a feminist perspective to bear on the interpretation of a major figure in the philosophical canon. In the case of Michel Foucault, however, this aim is somewhat ironic because Foucault sees his work as disrupting that very canon. Since feminists see their work (...) as similarly disruptive, Foucault and feminism would seem to find much common ground, but, as the contributors to this collection reveal, the matter is not so simple. Foucault, like many feminists, is centrally concerned with questions related to sexuality and the body. This concern has led both Foucault and feminists to challenge the founding concept of the modernist philosophical canon: the disembodied transcendental subject. For both Foucault and feminists, this subject must be deconstructed and a new concept of identity articulated. The exciting possibilities of a Foucaultian approach to issues of the subject and identity, especially as they relate to sex and the body, are detailed in several of the essays collected here. Despite these possibilities, however, Foucault's approach has raised serious questions about an equally crucial area of feminist thought-politics. Some feminist critics of Foucault have argued that his deconstruction of the concept "woman" also deconstructs the possibility of a feminist politics. Several essays explore the implications of this deconstruction for feminist politics and suggest that a Foucaultian feminist politics is not viable. Overall, this collection illustrates the range of interest Foucault's thought has generated among feminist thinkers and both the advantages and liabilities of his approach for the development of feminist theory and politics. Like most people, I used to think of my conscious life as like a stream of experiences, passing through my mind, one after another. But now I’m starting to wonder, is consciousness really like this? Could this apparently innocent assumption be the reason we find consciousness so baffling?

Some prominent contemporary ethicists, including Peter Singer and Jeff McMahan, do not consider human beings with profound intellectual disabilities to have the same moral status as “normal” people. They hold that individuals who lack sufficiently sophisticated cognitive abilities have the same moral value as nonhuman animals with similar cognitive capacities, such as pigs or dogs. Their goal—to elevate the moral standing of sentient nonhuman animals—is an admirable one which I share. I argue, however, that their strategy does not, in fact, (...) achieve this goal and that there are better ways to advance it than to attach lesser value to the lives of profoundly intellectually disabled persons. Susan Hekman believes we are witnessing an intellectual sea change. The main features of this change are found in dichotomies between language and reality, discourse and materiality. Hekman proposes that it is possible to find a more intimate connection between these pairs, one that does not privilege one over the other. By grounding her work in feminist thought and employing analytic philosophy, scientific theory, and linguistic theory, Hekman shows how language and reality can be understood as an indissoluble unit. Consciousness is a hot topic. Relegated to the fringes of science for most of the twentieth century, the question of consciousness only crept back to legitimacy with the collapse of behaviourism in the 1960s and 1970s, and only recently became an acceptable term for psychologists to use. Now many neuroscientists talk enthusiastically about the nature of consciousness, there are societies and regular conferences, and some say that consciousness is the greatest challenge for twenty-first century science. Although confusion abounds, there is (...) at least some agreement that at the heart of the problem lies the question of subjectivity - or what it’s like for _me_. As philosopher Thomas Nagel (1974) put it when he asked his famous question "What is it like to be a bat?" - if there is something it is like _for the bat_ then we can say that the bat is conscious. This is what we mean by consciousness - consciousness is private and subjective and this is why it is so difficult to understand. (shrink)

Although sexual violence against women is on-going and widespread, it is generally not, except in some cases of rape in war-time, viewed as a politically significant phenomenon constituting a grave group-based injustice. After examining why this is the case, Brison argues that one strategy to make salient the political dimension of sexual violence is to call rape "gender-based violence" rather than "sex without consent." Doing so takes rape out of the apolitical interpersonal realm and reclassifies it as a form of (...) injustice by situating it in the contexts of both criminal and civil rights law. (shrink)

Despite the existence of a large number of models to explain the ethical decision-making process, rarely have the models been tested. This research validated the use of such models by showing that both issue-contingent variables and individual characteristics affect two commonly-proposed model components: i.e., moral judgment and moral intent. As proposed by Jones' (1991) ethical decision-making model and elaborated on by the author, the main effect of an issue-contingent variable, social consensus, and a closely-related variable, seriousness of consequences, influenced both (...) moral judgment and moral intent.Many ethical decision-making models also argue for the inclusion of individual characteristics in the decision-making process. This study proposed and found that the individual characteristics of rule orientation and denial of responsibility influenced moral judgment and moral intent, respectively. However, contrary to some models, interactions between issue-contingent variables and individual characteristics were insignificant relative to the main effects variables. The relationships found have implications for future model testing, as well as for practising managers. (shrink)

Feminist and queer theorists influenced by Michel Foucault have given analyses of sexual violence and of sexually violent pornography that are generally taken to be in striking opposition to those defended by radical feminists such as Catharine MacKinnon. In this commentary on Linda Martín Alcoff’s Rape and resistance: Understanding the complexities of sexual violation, I suggest that these seemingly divergent analyses of sexual violence are more similar than they have appeared to be and I ask: Might this book help to (...) bring an end to the so-called ‘sex wars’ between the Foucauldians and the MacKinnonites that have been raging since the mid-1980s? On July 4, 1990, while on a morning walk in southern France, Susan Brison was attacked from behind, severely beaten, sexually assaulted, strangled to unconsciousness, and left for dead. She survived, but her world was destroyed. When we wake up from being chased by a ferocious tiger, or seduced by a devastatingly good-looking Nobel Prize winner we realize with relief or disappointment that "it was only a dream.".

That's the First Amendment,” he added. Jay Alan Sekulow, the lawyer for the petitioners, anti-abortion protesters who had been enjoined from moving closer than fifteen feet away from those entering an abortion facility, was obviously pleased by this characterization of the right to free speech, replying, “That's certainly our position on it, and that (...) is exactly correct …”. This essay examines the connections between dress, religion, and gender, specifically, contextual practices and underlying beliefs concerning dress among women in Tuareg communities of Niger and Mali, West Africa, who speak a Berber language, Tamajaq, predominantly adhere to Islam, are semi-nomadic, socially stratified, and display influences from pre- and popular Islamic, nation-state, and global forces. The Tuareg data reveals both common themes and inter- and intra-cultural variations in Muslim women’s dress, thereby challenging monolithic interpretations of women’s dress in Islamic communities.More (...) broadly, the essay calls for attention to the contested meanings of dress in terms of its special semiotic qualities: it is portable, can be disassembled and reassembled, and can be subtly re-arranged to convey ambiguous but powerful meanings that are neither unitary or stable. The virulence of a virus is determined by its ability to adversely affect the host cell, host organism or population of host organisms. Influenza A viruses have been responsible for four pandemics of severe human respiratory disease this century. Avian species harbour a large reservoir of influenza virus strains, which can contribute genes to potential new pandemic human strains. The fundamental importance of understanding the role of each of these genes in determining virulence in birds and humans was dramatically emphasised (...) by the recent direct transmission of avian influenza A viruses to humans, causing fatal infection but not community spread. An understanding of the factors involved in transmission between avian and mammalian species should assist in the development of better surveillance strategies for early recognition of influenza A virus strains having human pandemic potential, and possibly in the design of anti‐viral strategies. This book is an original discussion of key problems in moral theory. The author argues that the work of recent feminist theorists in this area, particularly that of Carol Gilligan, marks a radically new departure in moral thinking. Gilligan claims that there is not only one true, moral voice, but two: one masculine, one feminine. Moral values and concerns associated with a feminine outlook are relational rather than autonomous; they depend upon interaction with others. In a far-reaching examination and critique (...) of Gilligan's theory, Hekman seeks to deconstruct the major traditions of moral theory which have been dominant since the Enlightenment. She challenges the centrepiece of that tradition: the disembodied, autonomous subject of modernist philosophy. Gilligan's approach transforms moral theory from the study of abstract universal principles to the analysis of moral claims situated in the interactions of people in definite social contexts. Hekman argues that Gilligan's approach entails a multiplicity of moral voices, not just one or even two.
